Terms and Conditions For 100% Satisfaction Guarantee |

Everworks 100% Satisfaction Guarantee applies only to Rackworks (Server Co-location) Packages and valid for the first 30 days of subscription. |
 |
Refund applies only to monthly fees and setup fees. |

The Everworks Satisfaction Guarantee starts on the date the initial order was placed and it does not include Serverworks, Enhanceworks or etc. |
 |
No refund on any additional or optional services or features added from the client. |
 |
Each customer can only use the Satisfaction Guarantee once, and for only one account. |

Any customer who has breached or whose account has been suspended or terminated due to the breach of any part of the Everworks Agreement will automatically be forfeited the right to use the Everworks Satisfaction Guarantee. |

Graphical images used does not reflect on the actual product, services and etc. |
2.

Upon subscription of Rackworks ( Server Co-location ) & ServerWorks ( Dedicated Server ), a 1 year agreement is automatically included. |
3.

1 month deposit for collocation and 2 months deposit for dedicated server is a standard industry practice and is required |

1 month advance payment is required |

Payments have to be made either by direct bank in or cheque |
6.

All images, information, data, packages has been copyrighted and any duplication of information is forbidden unless is officially approved by Everworks Solutions (M) Sdn Bhd . |
7.

Everworks Solutions (M) Sdn Bhd reserves the right to alter or change any content of the website which includes the products and services without the consent from the customer or visitor. |
8.

Customer is responsible for use of license software on Authenticated and Non-authenticated licenses. |
9.
|
The minimum Service Term required is one (1) year, there will be a 50% penalty on the remaining subscription fees if contract is terminated by default. |

The Customer is solely responsible for the content of any postings, data or transmissions using the Services (the “Content”), or any other use of the Services by the Customer or by any person entity the Customer permits to access the Services (a “User”). The Customer represents and warrants that neither it nor any User will use the services for unlawful purposes (including, without limitation, infringement of copyright or trademark, misappropriation of trade secrets, wire fraud, invasion of privacy, illegal pornography, obscenity, defamation, and illegal use, transportation or sale of tobacco, controlled substances and firearms), or to interfere with, or disrupt, other network users, network services, or network equipment. Disruptions include, without limitation, distribution of unsolicited advertising or chain letters, repeated harassment of other network users, wrongly impersonating another user, falsifying one's network identity for improper or illegal purposes, sending unsolicited mass e-mailings, propagation of computer viruses, using the network to make unauthorized entry to any other machine accessible location, via the network, and distributing of tools designed for compromising security (i.e. including, but not limited to, password guessing programs, cracking tools or network probing tools). Everworks may suspend or terminate the Services immediately, with prior notice to the Customer. |

The Customer shall defend, indemnify, and hold harmless Everworks from and against all liabilities, judgments, claims, damages, settlements, expenses and costs (including reasonable attorneys' fees and litigation expenses) arising out of or relating to any and all claims by any person relating to use of the Services. |
12.

Everworks liability (including, for purposed of this paragraph only, and of its employees, agents, or representatives), to the Customer (either directly or as a third party defendant in any action or proceeding) for any claim arising out of or relating to this Agreement or Agreement or the provision of any Services under Agreement (including, without limitation, maintenance and support) shall be limited to the amount of fees paid by the Customer to Everworks. |

Standard Service Level Agreement (SLA) for data centre network is 99.9%. (based on standard industry SLA on IDcworks.com ) |
